The terms and conditions governing access to and use of the RailVision platform, website, and associated services.

Important: Please read these Terms of Service carefully before accessing or using the RailVision platform. By accessing or using our services, you agree to be bound by these terms. If you do not agree, you must not use our services.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (or your organisation) and RailVision ("we", "us", "our") governing your access to and use of the RailVision platform, website, APIs, and any associated services (collectively, "Services").

By accessing or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated by reference. If you are accessing the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Platform & Services

RailVision provides an intelligent railway digital twin platform that includes:

  • Live signal and train monitoring across the Derby control area
  • Replay and historical data analysis tools
  • Headcode route visualisation and geographic mapping
  • Train maintenance and coach information interfaces
  • Live Train Describer (TD) data feeds and monitoring
  • Platform model and live departure/arrival information

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice where practicable. We will endeavour to provide advance notification of any material changes that affect contracted users.

3. Eligibility

The RailVision platform is intended exclusively for use by railway industry organisations and professionals, including but not limited to:

  • Train operating companies (TOCs) and their staff
  • Rail infrastructure operators and Network Rail personnel
  • Transport authorities and regional transport bodies
  • Railway data engineers and technology partners
  • Performance analysis and delay attribution teams
Our Services are not intended for general public use. Access is granted on a commercial or partnership basis. If you are not a railway industry professional or organisation, you are not eligible to use the platform.

You must be at least 18 years of age to use our Services.

4. Accounts & Access

Where platform access requires an account, you are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Ensuring your account information remains accurate and up to date
  • Notifying us immediately of any unauthorised access or security breach

Account access may not be shared, transferred, or sublicensed to any third party without our prior written consent. We reserve the right to suspend or terminate accounts that are shared, compromised, or used in breach of these Terms.

5. Permitted Use

Subject to your compliance with these Terms and any applicable service agreement, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your internal railway operations and business purposes.

Permitted uses include:

  • Operational monitoring and real-time train and signal visibility
  • Historical replay and delay attribution analysis
  • Fleet and maintenance data review for operational planning
  • Internal reporting and performance analysis
  • Integration with your organisation's internal systems via agreed API access

6. Prohibited Conduct

You agree not to:

  • Use the Services in any way that violates applicable law or regulation
  • Attempt to gain unauthorised access to any part of the platform or its underlying systems
  • Reverse engineer, decompile, or disassemble any component of the Services
  • Scrape, harvest, or systematically extract data from the platform without authorisation
  • Use the Services to transmit malicious code, spam, or disruptive content
  • Resell, sublicense, or commercially exploit access to the Services without written consent
  • Interfere with the integrity, performance, or availability of the platform
  • Use real-time operational railway data for any purpose outside your authorised use case
Misuse of live operational railway data may constitute a breach of these Terms and may have safety implications. Violations will be treated seriously and may result in immediate account termination and legal action.

7. Intellectual Property

All intellectual property rights in the RailVision platform — including its software, design, code, data models, visualisations, and documentation — are and remain the exclusive property of RailVision or its licensors.

Nothing in these Terms transfers any intellectual property rights to you. Your licence to use the Services does not include any right to copy, reproduce, distribute, or create derivative works based on our platform without prior written consent.

Certain data displayed within the platform (such as Network Rail TD feeds and timetable data) is sourced under licence. Third-party data rights are retained by their respective owners.

8. Data & Operational Content

By using the Services, you acknowledge that:

  • Operational railway data displayed is for informational and analytical purposes only
  • Data accuracy is dependent on upstream feed reliability and is not guaranteed to be error-free
  • Live operational data must not be used as the sole basis for safety-critical decisions
  • Historical replay data may have gaps or inconsistencies arising from data feed interruptions

Any data you submit to the platform (such as enquiry form data) is governed by our Privacy Policy. We do not claim ownership of data you provide, but grant us a licence to use it to deliver the Services.

9. Availability & Service Levels

We endeavour to provide a reliable and highly available platform, but we do not guarantee uninterrupted access. The Services may be affected by:

  • Planned maintenance windows (communicated in advance where possible)
  • Upstream data feed interruptions from Network Rail or third-party providers
  • Force majeure events outside our reasonable control
  • Infrastructure or network issues beyond our control

Specific service level commitments, where applicable, are set out in your commercial agreement with RailVision. Platform status is available at status.railvision.io.

10. Limitation of Liability

To the fullest extent permitted by applicable law, RailVision shall not be liable for any:

  • Indirect, consequential, incidental, or special damages arising from use of the Services
  • Loss of revenue, profit, data, or business opportunity
  • Damages arising from reliance on inaccurate or incomplete operational data
  • Interruptions to service beyond our reasonable control

Our total aggregate liability to you shall not exceed the amounts paid (if any) by you to RailVision in the twelve months preceding the claim. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

We reserve the right to suspend or terminate your access to the Services immediately if:

  • You breach any provision of these Terms
  • We are required to do so by law or regulatory authority
  • Your account is involved in fraudulent or abusive activity
  • Your organisation ceases to be an eligible railway industry user

You may terminate your use of the Services at any time by ceasing access and notifying us in writing. Upon termination, your licence to use the Services ends immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, liability, and governing law clauses) shall remain in effect.

12. Governing Law

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice to active users via email or platform notification.

Your continued use of the Services after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must cease using the Services.
